On Tuesday, Feb. 10, I tried to contact the Property Manager over some landscape, paint, trash, and dog feces issue. I wanted to set up a meeting with her (Angela),but was told that she was too busy to run down there and meet me. I was told to email her to set up an appointment and that she was not able to make an appointment with me over the phone. No clear reason for that was given. Oh well, I sent her an email immediately following the phone conversation and still have not heard from her.

In the Bylaws of Sierra Pointe HOA, Article VIII: Duties of the Board of Directors, Section 2, states:

(d) cause the Common Elements to be maintained, repaired, renovated, rehabilitated and refurbished

Section 1 (h) states: designate and remove personnel necessary for the operation, maintenance, repair, and replacement of the Common Elements.

Common Elements are defined by a large list in the Condominium Declaration, Section 1, as basically the buildings, grass, sidewalks, trees, etc.

So, the Board of Directors designated the Property Manager to maintain, repair, renovate, rehabilitate, and refurbish the Common Elements. Below are the pictures of the area below my condominium I would like to be addressed. The first picture is what is on the Sierra Point website(SierraPointeHOA.com)--kind of misleading from my pictures that I see everyday.

Here is what I see:
Rules and Regulations: Section 5.1
The sidewalks....are not to used for the storage...of objects including bicycles, grills, trash bags, etc
Rules and Regulations

I feel that I have not asked anything unreasonable to have Angela meet me down at my place at her convenience to look at these issues. The purpose of the HOA is to maintain property values. These issues will definitely not raise the value of my condo but will defiantly drop . The Bylaws and Rules and Regulations address the regulations for these issues. Since the HOA dues pay for the Property Manager, I have the responsibility to report these issues. The Property Manager in return has the obligation to fix them. If the Property Manager is too busy to address them, then:

Bylaws of Sierra Pointe HOA, Article VIII: Duties of the Board of Directors, Section 1, states:

Section 1 (h) states: designate and remove personnel necessary for the operation, maintenance, repair, and replacement of the Common Elements.

To summerize: It may be time to look for a new Property Manager.
